Copyright laws are intended to protect the rights and interests
of authors and artists, to protect their due credit and financial
compensation for their works against piracy, against other people
stealing their deserved credit and profits.
Copyright laws are also intended to protect the licences and
patents belonging to inventors and entrepreneurs. Trade secrets
belong to this category. If a company puts a new popular soft
drink on the market, the recipe may be classified as a trade
secret. On the other hand, the Food and Drug Administration must
have access to the list of ingredients to ensure that the drink
is not harmful to public health.
The copyright claim of the RTC concerning the NOTs and other
documents is based upon a blatant and brutal abuse of this law
and its intent. This abuse of law by the Scientologists has become
a sinister threat against freedom of speech, freedom of the press,
freedom of the internet - basically everything covered by the
First Amendment rights in the American Constitution.
The CoS has used mafia methods to force the courts to agree
with them in America. These methods have included doing very
mean things to "uncooperative judges," such as slashing
their tires, killing their pets, or getting them booted from
office by falsely convincing the public that they are pedophiles
and the like. I would say that the methods used by the cocaine
cartels in Colombia are much more humane and honest. They simply
assassinate hostile judges.
Apart from all this, all the noise about the TRC copyright
claim is diffuse contradiction in terms that befogs anyone who
tries to understand it. Ron Hubbard's "tech" is a registered
trade secret because it is a recipe for religious technology
- a therapy that is sold for huge amounts of money. At the same
time, the controversial documents in question is part and parcel
of the CoS religious scripture, their holy writings. By their
very definition, religious scripture or holy writings cannot
be classified as trade secrets, but by deceit and trickery the
Scientologists have somehow pulled that off.
The reason for this confusion is that even though we are dealing
with business interests here, we're not really dealing with religion
in the ordinary sense, but with occultism, with an occult technique
called religious technology. And because occultism is such an
exotic, peripheral, obscure and sensation-mongering topic in
our culture, the legal system world wide, especially in America,
has proven almost impotent in the face of this challenge. Because
we're not just dealing with a mafia, but with an occult mafia.
A comparison to a soft drink recipe and the FDA may be appropriate
here, because the public has a right to know if there are any
dangers to physical and mental health in this religious technology
that the CoS is selling to the public at large (their "raw
meat") all over the world. The NOTs may be hard to digest
and even worse to understand, but they do prove that Ron Hubbard
was a very talented man whose sinister genius must not be underestimated.
Hubbard knew his occultism and his tech - have no illusions about
this.
An apologist for the CoS once pointed out to me that our approach
to a study of Dianetics and Scientology should be unbiased, objective,
and scientific. My answer was that if he really wanted to be
scientific about it, we should start with clinical psychology
and forensic medicine: The extraordinary high statistics of ex-Scientologists
with seriously impaired mental health, sometimes also physical
health, and the baffling number of strange deaths, suicides,
covered-up homicides, etc. that runs through the history of the
CoS like a river of human blood. that's what an unbiased, objective,
and scientific approach to Dianetics will lead you to: The morgues.
What the NOTs are concerned, no copyright violations have
ever taken place if we examine what such violations would imply.
Nobody has claimed personal authorship of the NOTs texts or gained
personal profit from them. On the contrary, the parties concerned
have suffered losses and abuses. So thank you Karin, Zenon, Andreas
and others for your most valuable public service in this case
of the People vs. the CoS.

Good essay summarising the position, though I don't think
it has in the practical sense got us any further forward; only
told us rather accurately where we stand right now.

There are other causes: to promote the publication of new
literature by attaching a protected value to new literature by
providing a controlling license to the authors. There have been
many other reasons for it: censorship and secrecy have, historically,
been powerful reasons to use copyright.
The copyright claim of the RTC concerning the NOTs and

including the alteration of publication dates on materials submitted
to the US copyright offices when original publication before
a certain date would have prevented the issuing of copyright.

Umm. Actually, David Mayo was proven in court to have written
a substantial portion of the NOTs. He did so as an employee of
L. Ron and/or RTC, and therefore was unable to claim personal
copyright, but he did write a lot of them.
